Terms and Conditions

These terms apply when you enroll in or attend any class offered by HoopStar Academy, operated by The Green Apple. By enrolling, you agree to these terms.

1. Our Classes

HoopStar Academy offers online hula hoop and fitness classes for children and adults via video call (Google Meet). Classes are organized into batches — a fixed set of sessions with a scheduled day and time.

Age groups:

Kids 4–6 years (parent supervision required)
Kids 6–18 years
Adults 18+

We do not accept students below age 4.

2. Enrollment

Enrollment is done via WhatsApp or the HoopStar mobile app.
A parent or guardian must enroll on behalf of any student under 18.
Each batch has a maximum capacity. Enrollment is first-come, first-served.
We reserve the right to cancel or reschedule a batch if minimum enrollment is not met. In such cases, you will receive a full refund or be moved to another batch.

3. Payments

Full payment is due before the batch start date.
Prices are listed on our website, app, and shared during enrollment. Current pricing is shared during the enrollment conversation.
Payments are processed securely through certified payment partners. We do not store your card details.
All prices are inclusive of applicable taxes unless stated otherwise.

4. Refunds & Cancellations

Before batch starts: Full refund if requested at least 48 hours before the first session.
After batch starts: No refunds for partially attended batches. If you miss sessions, they cannot be carried over.
Batch cancelled by HoopStar: Full refund or transfer to another batch (your choice).

5. Hula Hoop Products — Shipping & Refunds

Shipping:

Orders are processed within 2–5 business days. Delivery timelines depend on your location and the shipping partner.
Shipping charges, if any, are displayed at checkout and are non-refundable.
HoopStar Academy is not responsible for delays caused by the shipping partner, customs, or incorrect address provided by the buyer.
Risk of loss and title for products pass to you upon handover to the shipping partner.

Returns & Refunds:

Due to the nature of the product, hula hoops are non-returnable and non-refundable once delivered, unless the product is damaged or defective on arrival.
If you receive a damaged or defective product, you must notify us within 48 hours of delivery with photos of the damage. We will arrange a replacement or refund at our discretion.
Claims raised after 48 hours of delivery will not be accepted.
Refunds, if approved, will be processed within 7–10 business days to the original payment method.
Products that have been used, altered, or show signs of wear are not eligible for replacement or refund.

6. Missed Classes

If a student misses a class, we will try to accommodate a makeup session in another batch of the same level, subject to availability.
Makeup sessions are not guaranteed.
If a teacher is unavailable, we will provide a substitute or reschedule the session.

7. Student Conduct

Students should join on time with cameras on.
A safe, clear space is needed for hula hoop practice.
Respectful behavior toward teachers and fellow students is expected.
We reserve the right to remove a student from class for disruptive behavior.

8. Health & Safety

Hula hooping is a physical activity. By enrolling, you confirm that:

The student is physically fit to participate.
You have consulted a doctor if the student has any medical conditions that may be affected by physical activity.
You will ensure a safe practice environment at home (clear space, no fragile objects nearby).

HoopStar Academy is not liable for any injuries that occur during home practice or class participation.

9. Photos, Videos & Recordings

Classes may be recorded for teacher training and quality assurance.
We may use screenshots, photos, or short clips from classes for marketing purposes, including social media, website, and advertisements.
If you share your child’s photos or videos with us (via WhatsApp, social media, or any other channel), you grant HoopStar Academy permission to use that content for marketing and promotional purposes. Once shared and published, it may not be possible to fully retrieve or remove the content from all platforms.
If you do not want your child’s image used in marketing, please inform us in writing at hello@hoopstar.academy before sharing any content. We will make reasonable efforts to exclude them going forward, but cannot guarantee removal of content already published or shared with third-party platforms.
Students and parents must not record, screenshot, or redistribute class content without written permission from HoopStar Academy.

10. Intellectual Property

All class content — including choreography, teaching methods, music playlists, and recordings — is the property of HoopStar Academy. You may not copy, share, or commercially use any class material.

11. Communication

WhatsApp is our primary communication channel for class reminders, schedule changes, and updates.
By enrolling, you consent to receiving messages from us on WhatsApp.
You can opt out of promotional messages at any time by replying “STOP” or contacting us.

12. Disclaimer

Our services are provided “as is” and “as available.” HoopStar Academy makes no warranties, express or implied, regarding the quality, accuracy, or suitability of classes, content, or any results from participation. We do not guarantee any specific learning outcomes, fitness results, or skill development.

13. Limitation of Liability

To the maximum extent permitted by law, HoopStar Academy and its owners, directors, employees, teachers, and agents shall not be liable for any incidental, special, or consequential damages, including but not limited to lost profits, loss of data, personal injury, or emotional distress arising out of or in connection with:

Your use of or inability to use our services
Technical issues on your end (internet, device, audio/video problems)
Injuries during practice at home or during class
Any interaction with teachers or other students
Any third-party content, products, or services

Our total liability for any claim arising from our services is limited to the fees you paid for the specific batch or product in question.

14. Indemnification

You agree to release, defend, and hold harmless HoopStar Academy (The Green Apple), its owners, directors, employees, teachers, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or connected with:

Your use of our services, website, or app
Your violation of these terms
Your enrollment in or attendance of any class
Any injury or damage occurring during practice or class participation

15. Termination & Suspension

We reserve the right to suspend or terminate your access to our services at any time, without prior notice, for conduct that we determine to be in violation of these terms, harmful to other students or teachers, or harmful to our business interests.
Upon termination, your right to use our services ceases immediately. No refund will be provided for any remaining sessions in the batch.
Sections relating to intellectual property, indemnification, limitation of liability, and governing law survive termination.

16. Force Majeure

HoopStar Academy shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to natural disasters, pandemics, internet or power outages, government actions, or any other events beyond our control. In such cases, class schedules may be adjusted without liability.

17. Governing Law & Disputes

These terms are governed by the laws of India. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

18. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and HoopStar Academy regarding the use of our services. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

20. Changes to These Terms

We may update these terms from time to time. The latest version will always be available on our website. Continued enrollment or use of our services after changes means you accept the updated terms.
